How to Search the Braxton County Court Docket
Match the court to the paper in hand. Civil and criminal Circuit Court cases in Braxton County are public. The West Virginia Public Access Search System, called WVPASS, holds them. Traffic tickets, misdemeanors, preliminary felonies, and smaller civil claims run through Magistrate Court instead. For those, use the Magistrate Case Record Search, or MCR. Family cases take extra patience. The Circuit Clerk keeps the file locally, though court rules restrict what you may see in it. And a town ordinance citation stays with the town itself. Review moves it into Circuit Court only sometimes.
- Read the paperwork and identify the court and county.
- Keep the party name and full case number exactly as printed.
- Choose WVPASS for Circuit Court or MCR for Magistrate Court.
- Review the newest filing, event schedule, and disposition entries.
- Call the correct clerk for a missing document, current date, or certified copy.
A dead end online rarely means the case is gone. Try the other court level first. Then ask the Braxton County clerk who handles that court. They can confirm the case number and where the file sits. Some older Circuit cases simply predate the public system. No single statewide database gathers every municipal matter.
Braxton County MCR Search Screen
Before MCR shows you anything, it serves up a disclaimer and a CAPTCHA. The search form then takes a first name, last name, or case number. It caps results at 30 records. With a common surname, that cap can hide real matches. An exact case number is the strongest tool when you have one. Results can also be spotty. The local clerk still gets the final word on what the file truly says. The official Braxton County magistrate search screen is the public entry point.

Know what the screen gives you. It returns basic case data and docket entries only, not scanned complaints, orders, or citations. For copies from the underlying file, contact Sharon Yost, the Magistrate Court Clerk, for a nominal statutory charge.
What a Court Docket Shows
Think of a Braxton County court docket as a dated index. It is not the full file. MCR breaks each result into basic information, charges, bonds, events, parties, and docket entries. On the civil side, Rule 79 requires the docket to record filed papers, service, appearances, orders, verdicts, and judgments. These appear in time order. WVPASS can go further and attach public Circuit Court document images. The fields described here help you tell a scheduled setting from a final result.
| Case number | Court-assigned identifier, such as 24-M15F-00113 in a magistrate format. |
|---|---|
| Case header | Location, filing date, type, style, trial type, and agency when shown. |
| Docket entry | Filing date, local code, description, and filer. |
| Event schedule | Date and time, room, location, judge, event type, and reason closed. |
| Disposition | Judgment, transfer, dismissal, plea, or other recorded outcome, best confirmed from the latest order. |
Blank space can still tell you something. An MCR record might state there are no civil judgments or no worthless checks yet still list other case events. Read the whole result together, not one line alone.
Braxton County Docket Entry Anatomy
The official sample lays out how the tables connect. Notice what it does and does not show. A hearing can close while the case continues. A bond entry can change without settling the charge. One notice sets a date; a later continuation entry moves it. Working top to bottom, then sorting entries by filing date, keeps those acts from blurring together. The official MCR case-detail example shows the section layout used for Braxton County docket results.

The sample teaches field labels, nothing more. It is not a certified record, so ask the Magistrate Court Clerk for the actual paper behind any entry.
- Notice of hearing
- An entry that announces a setting.
- Hearing continued
- The event moved to a later date.
- Hearing or event closed
- The event record closed, which does not alone dispose of the whole case.
- Transfer to Circuit Court
- The matter continues at the Circuit level under its record path.
Which Courts Keep Dockets
The court level decides both the docket and who keeps it. Braxton County shares the 17th Judicial Circuit with Clay, Gilmer, and Webster Counties. Its Family Court work belongs to the 27th Family Court Circuit alongside Pocahontas and Webster. Two county magistrates carry the lower-court caseload. Municipal court stands apart. Those are local bodies for ordinance cases.
| Court | Docket covers | Record path |
|---|---|---|
| Circuit Court | Felonies, major civil cases, equity, and lower-court appeals | WVPASS, then Circuit Clerk |
| Magistrate Court | Traffic, misdemeanor trials, felony preliminary steps, and eligible civil claims | MCR, then Magistrate Court Clerk |
| Family Court | Divorce, custody, support, paternity, and related matters | Circuit Clerk, subject to restricted access |
| Municipal Court | Town ordinance violations | Town clerk, recorder, or court contact |
The County Clerk handles deeds, vital records, elections, county commission records, and probate appointments. Despite the similar title, that office does not keep the Circuit or Magistrate docket.
When Braxton County Cases Change Courts
A felony complaint often starts life in Magistrate Court. Once there is a probable-cause finding or a waiver, an entry like MGTCC marks the move up to Circuit Court. From that point, the public record lives in WVPASS. The Circuit Clerk holds it too, rather than MCR. Appeals out of Magistrate or Municipal Court open a Circuit Court path too. A qualifying civil or family final order can go on to the Intermediate Court of Appeals of West Virginia. Criminal and juvenile routes run differently. A transfer is never a dismissal. Keep both case numbers. Note the last event in the lower court. The new case may lag before it appears in the next system. The Braxton County clerk is the best fallback during that gap. Remember that a lower-court docket and its Circuit successor stay separate records.
Process: complaint or citation → magistrate event → waiver or hearing → transfer or disposition → Circuit Court record when transferred.
Finding Court Dates and Settings
The Case Event Schedule in MCR can list the event type, date and time, room, and location. It can also show the judge and reason closed. The newest valid setting is the one to trust. A motion to continue is just a request. An old event marked closed proves nothing about a current date. For Circuit cases you may need to open the latest notice or order in WVPASS, because the state does not promise a separate Braxton County daily calendar. When the portal and a paper notice disagree, call the right office. Susan Lemon's Circuit Clerk office is 304-765-2837. Sharon Yost's Magistrate Court Clerk office is 304-765-7362. The full Braxton County court calendar process explains how to trace resets. The court posts no permanent remote-hearing link or public daily docket PDF, so get attendance details from the court itself. For weather or holiday closures, check the judiciary's closure page.
Braxton County WVPASS Record Coverage
WVPASS opened statewide public access in March 2025. Registration costs nothing, and searches are free too. According to the launch material, the system holds public Circuit Court records and documents dating to 1999 across all 55 counties. Downloads do carry a charge: a regular public user pays 25 cents per downloaded page plus a card-processing fee. Sealed filings and juvenile cases stay out entirely. The West Virginia court-record access landing page shows the Circuit and Magistrate systems side by side, which makes the boundaries easy to see.

That split matters in Braxton County. WVPASS supplies Circuit documents, MCR supplies magistrate information without filed images, and CourtPLUS serves authorized filers.
| Channel | Search | Documents |
|---|---|---|
| WVPASS | Case or name | Public Circuit files from stated coverage, with page charge |
| MCR | First name, last name, or case number | No online images; request from clerk |
| CourtPLUS E-File | Authorized filer history | Filer workflow, not the public case search |
Public Access to Dockets
West Virginia law presumes public inspection. Real exceptions still apply. The clerk may set reasonable rules that protect records while allowing inspection and copying during business hours. Court privacy rules curb sensitive identifiers and permit sealed filings. Family and juvenile records face separate restrictions. They differ from an ordinary public Braxton County civil docket.
Key rules:
W. Va. Code §51-4-2 makes court records open to inspection and requires clerk copies unless a special rule applies.
West Virginia Freedom of Information Act provides reasonable inspection and copying opportunities, subject to exemptions.
Rule of Civil Procedure 5.2 protects confidential identifiers and supports sealed unredacted filings.
W. Va. Code §49-5-103 restricts juvenile proceeding records except where statute allows disclosure.
A screen result is only a research aid. The clerk holding the source file furnishes the official or certified copy. Family pleadings, recordings, exhibits, and transcripts generally stay confidential even when an index or order is public.
Missing Braxton County Docket Results
A missing case can hide in several places. It might sit in the other state portal, a municipal system, a restricted family file, a juvenile file, or an archive outside WVPASS's stated coverage. New filings also lag the index. Check the case number and court name first. If the subject matter could fall in the other official system, search it next.
For a Circuit or Family file, ask the Circuit Clerk whether a paper file, authorization, or court order is required. For a Magistrate file, ask the Magistrate Court Clerk to validate the MCR result and provide the document. For an ordinance matter, call the relevant town. A blank screen proves nothing about a Braxton County court docket. MCR itself warns that its public data may not be complete or accurate. Work the chain instead of guessing.
Note: Ask which access route applies. Do so without requesting protected family, juvenile, or sealed details from clerk staff.

Braxton County Docket Copy Choices
A docket entry, a filed paper, and a certified copy are three different products. MCR shows index lines and events, never images. WVPASS can deliver eligible Circuit Court images at its published page charge. A clerk photocopy comes straight from the local file. Certification adds the clerk's authentication for formal use. Braxton County's published material lists no distinct certification charge, so confirm that amount before ordering.
| Item | Published amount |
|---|---|
| WVPASS public download | $0.25 per page plus card processing |
| Circuit Clerk plain copy | $1 per page |
| Clerk fax transmission | $2 |
| Abstract of judgment | $5 |
| Certified copy | Confirm with Circuit Clerk |
The local clerk FAQ gives the amounts. Plain copies and faxes each carry their own fee. Fees can change, and older or archived files may take staff time to retrieve. The county offers no mail-in certified-copy form and states no turnaround time.
Braxton County CourtPLUS Timeline
Braxton County brought Circuit and Family e-filing online in November 2018. The platform grew into CourtPLUS E-File. By July 2024, it was live across West Virginia. This tool serves attorneys and authorized filers. Its filing-history filters search by full case number, reference code, county, filing type, status, and date range. One caution: a status of Clerk Review or Judge Review is not a ruling, and the filing has produced no final order.
CourtPLUS does not replace WVPASS. The public should use WVPASS for a Braxton County Circuit record. Call the clerk when an image is missing. In July 2026, the judiciary announced CourtOne, a planned unified case-management project. That announcement promises nothing about old Braxton County files or any municipal docket. It is a plan, not a promise.
Braxton County Civil Filing Context
The judiciary's 2025 Annual Statistics Report puts Braxton County's Circuit civil docket in context. The report counts 52 general civil filings. Mental-health filings reached 28. Other civil cases added 21, adoptions 11, and guardianships eight, plus one administrative-agency appeal and one magistrate appeal. Read these as filings during the year, not pending cases or a disposition rate.
The near-real-time state dashboard is preliminary and may be revised. Treat the annual report as the authoritative source. Neither source breaks county totals into town-level caseload figures. Zeros in several report categories say nothing about all court activity.
Court Dockets by City in Braxton County
Four incorporated towns sit inside Braxton County, according to the 2020 Census. No fifth one exists. Each town handles its own ordinance cases. No single municipal docket database ties them together. Town contacts are the best first stop for a local ordinance citation. State-law traffic matters, on the other hand, land in Magistrate Court. Public Circuit records run through WVPASS.
Sutton Court Docket
Population 863 · Town citation payments exist, but local docket status needs town confirmation.
Gassaway Court Docket
Population 759 · The town office routes ordinance file and hearing questions.
Burnsville Court Docket
Population 394 · The town clerk is the published local records contact.
Flatwoods Court Docket
Population 264 · Municipal matters begin with the town office or local police contact.
Sutton serves as the county seat too. So it holds the physical hub for Circuit and Magistrate records. A town name on a citation does not settle which court you face. Check whether the charge cites state law or a local ordinance instead. And if an appeal is filed, it may open a brand-new Circuit case number.
